Morning sickness has plagued women since the beginning of time, and modern-day drug manufacturers have attempted to capitalize on this common complication by creating a solution in pill form. The pharmaceutical company GlaxoSmithKline created Zofran as an anti-nausea medication for cancer treatments, and the FDA quickly labeled it as a pregnancy category B drug. This means that Zofran was considered safe for use in humans because of successful trials in animal studies. The drug was never subject to human testing before being prescribed to thousands of child-bearing women.
More than 100,000 pregnant women were prescribed Zofran from their doctors despite a lack of evidence on the drug’s safety. The drug was initially meant to treat nausea occurring after cancer treatments, but drug companies and doctors decided to test in on pregnant women anyway. Horribly, the American Journal of Obstetrics and Gynecology reported that birth defects increased in as many as 30 percent of pregnant mothers who were prescribed Zofran. Commonly reported birth defects include skull deformities, musculoskeletal deformities, life-threatening fetal malformation, clubfoot, heart murmur, low birth weight, cleft lip, low birth weight, atrial septal defect, and jaundice. Some expectant mothers tragically lost their children due to complications arising from Zofran.
There are laws that protect doctors and pharmaceutical companies from being held criminally liable for negligence, but individuals harmed by prescription drugs can seek retribution in civil court. The representatives at the Law Office of Salter and Ferguson are dedicated to seeking justice for mothers and children whose lives have been adversely affected by Zofran. Zofran’s manufacturers can be held accountable for failing to notify doctors and patients about the potential dangers of the drug. It’s not too late to pursue justice for damage caused by a drug you took in good-faith under your doctor’s orders.
